Open Items
We have not resolved the issue or definition of “OPEN SPACE”; is it open to the public at large or only those affected?
Conservation vs. Preservation – We need to decide which word to use in this document – they are not interchangeable.
According to Webster’s New Collegiate the definition for each follows;
Conservation – 1: a careful preservation and protection of something; esp : planned management of a natural resource to prevent exploitation, destruction, or neglect 2 : the process of conserving quantity
Preserve – 1: to keep safe from injury, harm, or destruction : PROTECT 2 a : to keep alive, intact, or free from decay b : MAINTAIN 3 a : to keep or save from decomposition b : to can, pickle for personal or special use ~ vi 1 : to make preserves 2 : to raise and
protect game for purposes of sport 3 : to stand preserving (as by canning) adj - preservation
Consistent use of Commission or Planning and Zoning Commission – The two terms are used interchangeably we should decide on one and be consistent throughout the document.
How will the sign acquisition and enforcement be handled?
Specific comments on the DRAFT
Page 4 – Open Space: I believe it should read; Land within a Subdivision, Re-subdivision or Open Space Subdivision
Page 4 – Missing definition of “Pre-application Conference”
Page 5 – Resubdivision: I believe an item D: needs to be added if any modification to Open Space has occurred
Page 5 – Total Area: I believe it should read; The total area of the proposed Subdivision, Re-subdivision or Open Space Subdivision
Page 6 - Missing definition of “Yield Plan”
Page 8 – Purpose: I believe it should read;……Willington Plan of Conservation and Development, Willington’s Open Space Plan and Willington’s Natural and Cultural Resource Inventory prior….
Page 8 – Technical Reports: I believe it should read; The Commission may suggest the applicant to perform seepage or other tests as it deems advisable…..
Page 8 – Consideration of Preliminary Layout: How does this fit if this is a Pre-application Conference? It talks about hearings and public comment. This suggests the Pre-application meeting would need to be noticed.
Page 8 – Effect of Consideration of preliminary Layout: Does not appear to read correctly. Neither the applicant nor the Commission shall be in any way bound by any statement made during such Preliminary Layout consideration, it being acknowledged by the applicant that the Commission’s responses, like the request itself, are preliminary and subject to further change and refinement. There shall be no vote or other action on any request for Preliminary Layout consideration.
Page 10 – Item J. Proof of mailing of written notice of the application to the water company – Who would that be?
Page 10 – Item k. What about State Wildlife agencies for protected or endangered species?
Page 12 – Item e. I am personally not in favor of signs for this purpose.
Page 13 – Item 2. If signs are required for notification of a public hearing, then why aren’t signs required for “Notification of Action”? The same argument hold true for both. Will the applicant also be required to post signs based on Inland Wetlands Hearings?
Page 17 – Item d. Why is this needed? Seems like and added expense to what end? Is this required by State Statute or a nice to have? Who did this work before?
Page 17 – Item g. Should reference the 500ft requirement as outlined on Page 12 – item d.
Page 21 – Item 1 Purpose: I believe it should read; ……and that the design of any subdivision does not unreasonably pollute, impair, destroy, or create and unreasonable risk of polluting, impairing or destroying, the air, water or other natural and historic resources of Willington or the State.
Page 22 – Item 6 Driveways: I don’t understand why the last sentence in the first paragraph is necessary.
Page 23 – Item 10 Shade Trees: I would suggest the word “Conservation” be substituted for “Preservation”
Page 24 – I would add an item 13 after Grading that discusses; Stump and Debris Piles and reference state statutes
Page 35 – Item 1 – Purpose – I would suggest in (4) the word preserves be changed to conservation areas. (7) …urban and suburb…. the last paragraph, I suggest changing preservation to conservation. I would also suggest the reference to recreational uses be deleted
Page 35 – Item 1 under Requirement of Submitting an Open Space Subdivision Design – I would suggest changing “the Willington” to, delete “the” and substitute Willington’s. Same change in the last sentence.
Page 35 – Item 2 – I suggest changing sentence one to read ….plan for in consideration by the Commission…delete the word in. Sentence 2, I would suggest the wording be changed ……facilitate the general discussion of factors and potential problems…..Sentence 3, I suggest deleting the word “more”. The last sentence does not make sense to me appears to be missing words.
Page 36 – General Density Limitations – I suggest changing the wording to be ….shall be determined at the sole discretion of the Commission
Page 35 – Yield Plan – first paragraph last sentence…delete the “be” between ordinarily permitted
Page 36 – Section 6.05 – Item a – change the word preserved to conserved
Page 36 – Section 6.05 – Item b – “significant stands of trees, individual trees of significant size – Who determines this and what are the determination criteria
Page 36 – 37 Section 6.05 – Item c – I would suggest; Open space intended for recreation or other public used should be easily accessible to all individuals.
Page 37 – Section 6.05 – Item d – Suggest rewording, seems to vague
Page 37 – Item 3.a. – change approval to approved
Page 37 – Item 4 – Why the item “or tree removal”
Page 38 – Add item f. – Should “turn outs be required every 500ft in a common driveway situation”
Page 39 – Section 7.02 – I suggest adding “monuments” to the sentence discussing markers
Page 40 – Section 7.04 – Street Trees - I suggest adding the following to sentence 3, or any tree, bush or shrub that is listed as an exotic invasive specimen by the State of Connecticut.
Page 40 – Section 7.04 – Street Trees – In the last sentence historic trees are referenced with no definition or who determines or who defines a historic tree
Page 40 – Section – 7.06 – I suggest adding that “all blasting is to be coordinated and approved by Willington’s Fire Marshall
Page 40 – Section 7.07 – Does the Board of Selectmen and the First Selectman perform these functions today
